A Transitividade em Textos Jurídicos e a Relação com as Atividades de Sujeitos Processuais

ABSTRACT: The objective of this article is to present the analysis of the transitivity system in legal texts, using as framework the Systemic Functional Grammar proposed by Halliday & Matthiessen (2004). The analysis will focus on the elements of the ideational metafunction, materialized in clauses that realize basic processes (material, mental and relational) and intermediate processes (behavioral, verbal and existential. The corpus consists of texts from a Penal Process, judged in the Courthouse of Santa Maria, RS, Brazil. It has been analyzed clauses that constitute texts produced by four processual subjects, such as the chief of police, the public prosecutor, the defense attorney and the judge. The description and the analysis of the processes realized by the clauses allow us to verify how the language is used by the agents of legal institutions in texts which help them to accomplish their respective activities in the unfolding of a Penal Process.

RESUMO: O objetivo deste artigo é apresentar uma análise do sistema de transitividade em textos jurídicos, utilizando princípios da Gramática Sistêmico-Funcional com base em Halliday & Matthiessen (2004). A análise focaliza elementos da metafunção ideacional, materializada por orações que realizam processos básicos (materiais, mentais e relacionais) e processos intermediários (comportamentais, verbais e existenciais). O corpus de análise se constitui de textos que compõem um Processo Penal, julgado no Fórum de Santa Maria, RS, Brasil. São analisadas orações que constituem textos produzidos por quatro sujeitos processuais: o delegado, o promotor do Ministério Público, o defensor da ré e o juiz de Direito. A descrição e análise dos processos realizados pelas orações possibilitam verificar como a linguagem é usada por agentes da instituição jurídica em textos que os ajudam a executar suas respectivas atividades no decorrer de um Processo Penal.
